I. Introduction The importance of the famous Altmark ruling1 of the ECJ makes it the pivotal decision concerning the financing of public services. Although the ruling provided greater predictability for legal decisions, it raised several critical issues, inter alia the fourth criterion (the so-called ‘efficiency criterion’), which turned out to be impractical. However, the debate over the four criteria developed in the Altmark ruling died down after s
