In the Residex case1 the ECJ had to deal with the problematic civil law consequences of unlawful State aid, in a case where the aid is caused by a guarantee provided to a finance institution to cover a loan granted to a third party under conditions that this party could not have obtained under normal market circumstances. The case thus concerns a complex set of closely intertwined questions. As both the recovery of unlawful aid and the court protection
