In case T-154/10, the General Court dismissed an application brought by France for the annulment of the Commission decision of 26 January 2010 on a State aid granted to La Poste in the form of an “implied” guarantee arising from the legal status of La Poste (i.e. its status as an EPIC). The Authors note that the focus at both Commission and Court level has been on whether a guarantee existed and whether such guarantee led to better financial rating
