In the joined cases C-92/09 and C-93/09, the ECJ held that the provisions of Council Regulation (EC) No 1290/2005 and Commission Regulation (EC) No 259/2008 regarding the publication of personal data relating to beneficiaries of agricultural aid are invalid on account of the fact that they conflict with the fundamental right to data protection enshrined in Article 8 of the Charter of Fundamental Rights of the European Union.
