Many interesting observations can be drawn from comparing the elaborate European State aid regulation framework with the American way of handling threats to fair competition caused by State subsidies or measures. This article gives an overview of the American solutions to State aid issues of a strong contractual nature, which strikingly contrast with Europe’s heavy regulatory apparatus.
