Ryanair v Commission

In its judgment of 29 September 2011 in case T-442/07 Ryanair Ltd v European Commission (the “Judgment”)1, the General Court (the “Court”) declared that the Commission had failed to fulfil its obligations under the EC Treaty with regard to a number of alleged State aid measures. More specifically, and in particular, it failed to take a decision under Article 4(2), 4(3) or 4(4) of Regulation (EC) No 659/1999 (the “Procedural Regulation”).
