Legal Standing of Complainant, Unlimited Guarantee · Case T-135/17 Scor SE v European Commission · Annotation by Marie-Laure Combet and Lena Boucon
Annotation on the Judgment of the General Court (Seventh Chamber) of 6 May 2019 in Case T-135/17 Scor SE v European Commission
On 6 May 2019, the General Court issued its judgment in the Scor vs Commission Case, ending a 6 year-long legal battle initiated by Scor against the French State regarding unlimited guarantees in favour of its competitor CCR. This Case reminds us of the procedural difficulties facing third-party competitors when willing to challenge a Phase I State aid Decision on the merits. It also contributes to set a rare EU decisional precedent declaring a State aid in the form of an unlimited public guarantee compatible with the internal market.
