EStAL 1/2019 – State Aid Case Law in Evidence

The European State Aid Law Quarterly enters 2019 with fresh insights on the field and many lessons from the previous year. The ghost of Brexit is still looming, uncertain of where to haunt, and we take a look at what may happen with Brexit, the EEA and the EU State aid Rules; staple concepts are still fostering debate, as we see in the case of Engie and Selectivity, and FIH, the MEOP and Previous State Aid; plus a comprehensive analytic comparison of China’s Fair Competition Review System to EU State Aid Control.

Check our expert annotations on Joined Cases T-554/15 and T-555/15 Hungary v Commission and Joined Cases C-622/16 P to C-624/16 Montessori. We also feature a note on the Commission Decision on State Aid case SA.38454 on the PAKS II nuclear power station in Hungary.

Starting in this issue, EStAL will publish a quarterly Summary of all State Aid jurisprudence from the CJEU, briefly highlighting the major aspects of each judgment rendered by the Curia. We begin with a complete overview of cases from 2018.

In our News from the Member States section, we report on the latest developments in Austria, Belgium, Bulgaria, the EEA-EFTA States and France.

Read also an account of the most important State Aid event of 2018, the European State Aid Law Institute’s traditional Autumn Conference on European State Aid Law, organized by Lexxion.
