Developments in the Notion of Selectivity
I. Introduction Pursuant to Article 87.1 EC, in order to qualify as a State aid, a state measure must favor “certain undertakings or the production of certain goods”. A selective measure procures an advantage for “certain undertakings or the production of certain goods, to the exclusion of others.”1 A system which “is liable to place the undertakings to which it applies in a more favourable situation than others”2. The selectivity test is therefore ba
