Konsum Nord v Commission
I. Introduction It is an everyday setting: A city wants to relocate an undertaking away from the centre to a commercial zone. If the undertaking has no urgent interest in moving, it is in a strong bargaining position vis-à-vis the city. Because of this the municipality might have to pay a high purchase price or offer other incentives. In the Konsum Nord case, the municipality sold its land in the commercial zone allegedly below market value. The Co
